The CREATE Act (Republic Act No. 11534) exempted certain health products from Value-Added Tax (VAT). This included medications and medical devices for hypertension, cancer, mental illnesses, tuberculosis, kidney diseases, diabetes, and high cholesterol, as well as those specifically used for COVID-19.

The Food and Drug Administration (FDA) identifies VAT-exempt health products and informs other relevant agencies. However, the VAT exemption for COVID-19 medical devices, drugs, and vaccines ended on December 31, 2023, as stated in Section 12 of Republic Act No. 11534 (CREATE Act).

To reflect this change, the Bureau of Internal Revenue (BIR) issued a separate guidance through Revenue Memorandum Circular No. 7-2024. This circular specifies that COVID-19 medical devices, drugs, and vaccines are no longer VAT-exempt since January 1, 2024.
