Continuing the Government Regulation No. 39/2021 concerning Halal Product Implementation in Indonesia (refer to the link), Indonesia’s Halal Assurance Agency (Badan Penyelenggara Jaminan Produk Halal/ “BPJPH”) has issued further Decree from Head of BPJPH Regulation Number 133 of 2022 concerning the Procedures for Requesting Data Amendment on Halal Certificates. This regulation outlines the types of amendment allowed and the procedures for requesting changes in the Halal certificates as described below.

Types of Amendment
The following are the types of amendment in Halal certificates:

  1. 1. Transfer of Ownership in Halal Certificates due to acquisition, change of business entity, or others without changes in product type, product name, product quantity, materials, halal production process, and production/manufacturer location.
  2. 2.  Data Changes in Halal Certificates, with the following criteria:
    1. a. Data input error by the BPJPH validator in the halal certificate database causing the issued halal certificate to differ from the uploaded halal determination.
    2. b. Writing error in the halal decree by the fatwa commission of the Indonesian Ulema Council (Majelis Ulama Indonesia/ “MUI”), causing a misprint in the issuance of the halal certificate.
    3. c. Changes in the halal certificate number due to a change in the registration status (from new to development), thus the validity period of the halal certificate follows the validity of the main halal certificate.
    4. d. Changes in product name data caused by a proposal from relevant agency accompanied by written evidence.

Amendment Requirement
The following are the documents required for the halal certificate amendment in the Halal certificates:

  1. 1. Requirement for halal certificate amendment caused by transfer of ownership in the certificate
    1. a. Application Form for halal certificate amendment
    2. b. Statement letter signed on a stamp duty by leadership or managerial position in the company stating that there’s no changes to the product type, product name, product quantity, materials, halal production process, production/manufacturer location
    3. c. Amended Company deed or company establish documents and proof of legal transfer of ownership
    4. d. Halal certificate must be valid at least 6 months at the time of submission
    5. e. New owner must own a SIHalal account (Indonesia Halal Certificate Service System)
  1. 2. Requirement for halal certificate amendment caused by data change in the halal certificates
    1. a. Application Form for halal certificate amendment
    2. b. Halal stipulation/ decree (for writing error in halal stipulations and changes in the product name data caused by proposal from related agencies)
    3. c. Halal certificate must be valid at least 6 months at the time of submission
